LLMs and their implementation are one of the most problematic technologies of today.
A technology that is marketed as intelligent, but instead raises war, bias and consumption on huge scale. The nature of artificial neural networks is problematic in itself, as the nature of a computer chip is problematic in its centralized creation process.

This licence is made to address these problems.
It defines legally backed guidelines to tackle them. These guidelines should be applied in the following sense:
The first Priority is the existential proceeding of any instance. The second Priority is following and developing the guidelines. The third Priority is profit, which is limited by the following terms.

The definitions are based on the licence of redistribution 1.0 and include additional terms:

Instance: Refers to the GPT service and interface, along with all required software and hardware.

1. Terms of Use

- Users are required to pay €10 per month and are entitled to 100 daily requests.
- Owners must allocate a fixed percentage (minimum 20%) of the funds collected from users to enhance the instance.
- Enhancements must be conducted in an open-source manner by trying to exclude anonymous parties


2. Scaling and Limitations

When an instance reaches 500 users, new users must be registered to a new instance under a different owner on separate hardware. Each instance should ideally support up to 500 users. If an instance can handle more users (e.g., 1000), it should adjust its user limit and pricing according to the next Section 3. Financial Management.


3. Financial Management

A baseline of €5000 is established, reflecting a social wage factor of approximately five times.

In case the social wage is not existent in one country, the neighbour country with the highest social wage can be considered. In case there is no social wage in the country and in all neighbour country, it should be 5 times of what one needs in the country of the instance to live and not be defined as poor.

This figure may vary based on the choice between maintaining millions of smaller instances or fewer larger ones. A larger number of instances providing ground needs of the admins is always to be preferred. Each unit must try to distribute resources to other instances with the goal of ensuring mobility, housing, good food, and investment funds to the biggest number of humans possible. The overall goal is diversity in any dimension.
An example for clarity: If one instance could run on 2000 Euro income, but two could run on 1000 Euro income, the latter has to be preferred if possible, as for two humans autonomy, open source self Education and reasoning can be provided.

4. Data Handling

All instances should eventually form democratically organized unions. Having the biggest number of autonomous instances is always to be preferred over collective agreements.

Centralized data processing is permissible only if agreed upon by all members through democratic processes and the processing output information will be under public licences defined as common good. No individual's data may be used without the individual proactively wishing it. Usage should be independent of user identification. In that sense Cookie Banners are not allowed.

5. Responsibilities of Owners

Owners are obligated to:

- Enhance the instance in an open-source manner, using non anonymity to enforce it
- Manage funds collected from users for instance enhancements and other necessary expenses according to specified financial rules.
- Adhere to user limits and scaling procedures as outlined in this Agreement in Section 3.


6. Termination and Amendments

Either party may terminate this Agreement upon 30 days' written notice. Offgpt reserves the right to amend these terms at any time in case of emergency, violation of terms or unproper usage of the service such as breaking or destroying it. Continued use of the Platform after amendments - which will try to fullfill the general idea of the licence's goals - do not constitute acceptance of the new terms. These will be made through democratic processes.

7. Governing Law and Dispute Resolution

This Agreement is governed by the laws of Germany. Any disputes arising from or related to this Agreement shall be resolved through arbitration in German Court, in accordance with the laws given by the German Republic.
